AVVO Q&A #9: CAN I FILE A LIEN AS AN INDEPENDENT CONTRACTOR? I am an independent contractor and did work for a sub-sub contractor on 6 homes and have not been paid. What are my options to collect my money?

If you are a sub-sub-subcontractor you have no lien rights under Florida’s Construction lien law. If your services were however, just as a laborer, as opposed to a subcontractor who provided the labor of others, you may have lien rights. A laborer is not required to send a Notice to Owner but must lien within 90 days of his last furnishing.  To explore your lien rights, I suggest you contact a Florida Bar Board Certified Construction Attorney to assist you. Best to you.
